Jewels Mountain Poodles – Health Guarantee & Buyer’s Contract

 

This agreement is made between Jewels Mountain Poodles (“Breeder”) and the Original Buyer (“Buyer”) for the purchase of a puppy.

 

 

1. Health Guarantee

 

This puppy is guaranteed to the original Buyer for two (2) years against serious hereditary or genetic diseases, including Hip Dysplasia.

• If the puppy is diagnosed with a serious hereditary or genetic condition within this period, a replacement puppy of equal value will be provided when available.
• Written documentation from a licensed veterinarian must be submitted.
• The Breeder is not responsible for veterinary expenses, transportation costs, or related fees.

 

If the Buyer chooses to keep the affected puppy, the Buyer may receive a refund of one-third (1/3) of the purchase price after providing proof of spay or neuter.

This refund option applies only to puppies with confirmed genetic or hereditary health issues.

 

 

2. Initial Veterinary Examination

 

The Buyer agrees to have the puppy examined by a licensed veterinarian within five (5) business days of purchase.

(Breeder is not responsible for veterinary expenses.)

• If the puppy is found to have a life-threatening illness or disease (excluding parasites, giardia, or coccidia), the Breeder will replace the puppy with one of equal value when available.
• The puppy must be returned within seven (7) days of purchase along with written veterinary documentation.
• Transportation costs are the responsibility of the Buyer.
• The Breeder reserves the right to have the puppy examined by a veterinarian of her choosing to verify the diagnosis.

 

 

3. Spay / Neuter Requirement

 

The Buyer agrees to spay or neuter the puppy between 18–24 months of age (1½–2 years).

Failure to do so will void this contract.

• The Buyer understands that allowing natural hormones until maturity supports proper growth and development.
• Delays beyond 24 months may be approved only with prior written approval from the Breeder and for a valid reason.

 

 

 

4. Contract Void Conditions

 

This contract will be void if:

• The puppy is allowed to become overweight or obese
• The Buyer does not follow a limited or minimal vaccination program
• The puppy is bred in any capacity
• The Buyer uses Banfield Veterinary Hospital (emergencies exempted)

 

 

 

5. Veterinary Care & Vaccination Policy

 

The Buyer agrees to provide proper veterinary care, nutrition, housing, socialization, and grooming for the life of the dog.

 

The Buyer agrees to:

• Follow a limited vaccination program
• Avoid unnecessary medications when possible
• Research potential side effects before administering medications
• Seek natural alternatives when appropriate

 

 

 

6. Breeding Prohibition

 

The Buyer agrees NEVER to breed this puppy.

• No breeding for Doodles, Merle patterns, or any crossbreeding.
• Any puppy bred intentionally or accidentally is a breach of contract and must be returned to the Breeder.
• Buyer agrees to pay the Breeder up to $5,000 per puppy produced if crossbred puppies are born.

 

 

7. Exclusions:

 

Not covered under this guarantee:

• Adult coat color
• Bite

 

 

 

8. Purchase Terms

• Purchase price: $__________

• Balance due at pickup
• Puppy remains Breeder’s property until paid in full

 

 

9. Venue & Jurisdiction

 

In the event of any dispute, claim, or legal action arising from this contract, the Buyer agrees that exclusive venue and jurisdiction shall be in Wytheville, Virginia. All legal proceedings shall be filed and resolved in Wythe County, Virginia, and the Buyer waives any objection to venue or jurisdiction.
